Colorado Hearing Attempts to Remove Trump From the Presidential Ballot

A court in Colorado began a hearing on October 30 to determine if Donald Trump can be banned from holding public office.

A group of six Republican and unaffiliated voters filed a lawsuit that attempts to disqualify Trump from appearing on Colorado’s 2024 presidential election ballot by claiming he incited an insurrection on Jan. 6, 2021, on Capitol Hill.

Prosecutors say his involvement means he violated Section 3 of the 14th Amendment, which states:

No person shall … hold any office, civil or military … who, having previously taken an oath, … engaged in insurrection or rebellion against the same ….

According to attorney Eric Olson, Trump “summoned and organized the mob” that entered the Capitol building; therefore, he cannot run for president.

However, Trump did not “organize the mob,” neither was the January 6 protest an insurrection (see “January 6 Was a Setup”).

When it comes to decide who should lead our nation, it’s the people of the United States of America who make that decision, not six voters in Colorado who’ve picked and chosen who they should file a lawsuit against.

Supreme Court: The trial is expected to continue through to Friday, and a ruling is likely to be made by mid-November. No matter the court’s decision, the ruling is expected to be appealed to the state’s Supreme Court. That ruling could then be appealed to the United States Supreme Court.

A similar case against Trump will be heard in the Minnesota Supreme Court on Thursday. Other legal challenges are taking place in Michigan, New Hampshire and Arizona.

If any one of these states can remove Trump from the 2024 presidential election ballot, all other 49 states would have grounds to do the same. It likely will come down to the U.S. Supreme Court’s decision.
