Lawlessness by Design
The radical government in Washington, D.C., is not incompetent: It is immoral. The president of the United States has a constitutional duty to enforce federal laws protecting the 50 states, including immigration laws designed to protect U.S. citizens from foreign invaders. Despite this responsibility, the Biden administration has allowed 7.3 million aliens to cross the U.S. southern border since Joe Biden took the oath of office.
That number is more than the population in each of 36 of the 50 states. And unless the pace of illegal immigration dramatically slows down, fiscal year 2024 will break last year’s record of 2,475,669 encounters at the southwestern border.
Such negligence has real-world consequences. Latin American drug trafficking networks are expanding into the nation, drug overdose deaths are increasing, and girls as young as 11 are being sold as sex slaves.
Yet one of the most overlooked consequences of Biden’s intentional border catastrophe is the constitutional crisis.
A constitution is a set of principles by which a state is governed. Under a constitution, individuals give up certain rights to the government in exchange for security. Each of the 50 states has surrendered the right to make treaties with foreign powers and engage in war unless actually invaded (Article i, Section 10, Clause 3 of the U.S. Constitution). In return for these concessions, the federal government has guaranteed each state in the union a republican form of government and federal protection from foreign invasion.
By refusing to close the U.S. southern border, Joe Biden has violated his oath to faithfully execute immigration laws enacted by Congress and broken the basic compact between the federal government and the states. This creates a serious constitutional crisis. Yet it is only the beginning of the Biden regime’s treasonous behavior.
In addition to refusing to enforce U.S. immigration law itself, the Biden administration is now mobilizing to prevent the state of Texas from enforcing the law. It is not that the Biden administration is too lazy or incompetent to do its job. Rather, the Biden administration is on the side of the illegal aliens!
Battle for Texas
On his first afternoon in office, Biden signed 17 executive orders sweeping aside President Donald Trump’s pandemic response, environmental plans, economic agenda and immigration policies. One of these executive orders halted construction on Trump’s border wall with Mexico, and encouraged a caravan of 8,000 Central American migrants to start heading for the United States. When Biden did nothing to prevent this caravan from coming, illegal southern border crossings spiked sixfold—from 1,000 per day to more than 6,000 per day.
Texas Governor Greg Abbott waited more than a year for the Biden administration to step up and do its constitutional duty. Yet with millions of people from more than 160 countries crossing the border, Abbott could not afford to wait any longer. He issued an executive order on July 7, 2022, authorizing the Texas National Guard and the Texas Department of Public Safety to arrest migrants and deport them back to Mexico.
Abbott cited the U.S. Constitution as his authorization, saying Biden’s refusal to protect Texas from invasion “has forced the state of Texas to build a border wall, deploy state military forces, and enter into agreements as described in Article i, Section 10 of the U.S. Constitution to secure the state of Texas and repel the illegal immigration that funds the cartels.” It is hard to argue with his rationale. The southern border is being invaded.
Texas also started installing razor wire along the Rio Grande to deter illegal aliens from crossing. Rather than thank Texas for doing its job, federal Border Patrol agents have been coming along behind Texas agents to lift or cut the wire. Texas Attorney General Ken Paxton sued the Biden administration for this lawless behavior, but in November, a federal judge denied his request to stop Border Patrol from reopening the border.
Paxton appealed this decision to the U.S. Supreme Court. On January 22, the court issued a ruling allowing Border Patrol to continue carrying out Biden’s orders. This ruling probably isn’t the court’s last word on the issue.
This lawsuit reveals the Biden administration’s lawless spirit. Over the past three years, Texas has spent $11 million on 70,000 rolls of razor wire, and the Biden administration has literally destroyed state property to remove what few obstacles there are for millions of illegal immigrants to infiltrate the country. Rather than protecting Texas from invaders, Biden is facilitating the invasion.
We now have a constitutional crisis in progress. On January 24, Governor Abbott issued a statement that the Biden administration has “broken the compact between the United States and the states.” And since Article i, Section 10, Clause 3 of the U.S. Constitution says, “No state shall, without the consent of Congress … enter into any agreement or compact with another state, or with a foreign power, or engage in war, unless actually invaded,” Abbott is instructing the Texas National Guard to continue rolling out razor wire to slow the invasion.
Fundamental Transformation
Many people struggle to understand what the Biden administration is trying to accomplish by fighting Texas over this issue. On January 23, a Fox News reporter asked National Security Spokesman John Kirby the question on the minds of millions of Americans: “Why are you guys making it easier for people to enter the country illegally?” Kirby initially dodged the question, but eventually admitted that Border Patrol was cutting the wire to gain “the access they need to better process the people who are trying to get across the border.”
You read that right! Border Patrol does not want razor wire to serve as a deterrent to illegal entry. Rather, they want to facilitate the flow of illegal aliens across the border and into the interior. Since January 2021, the Biden administration has released nearly 3.5 million people into the United States with instructions to come back later for their court hearing, despite knowing that most will not show up.
Trevor Loudon, a communism expert and contributor to the Epoch Times, has noted that it would only take an additional 15 million to 25 million Democratic voters to transform America into a one-party dictatorship, and that the best way to get these voters is to open the southern border. So Biden does not care that a majority of Americans disapprove of how he is handling the border crisis, because he is not trying to increase his popularity among Americans. Illegal immigration and election fraud are means for holding onto power.
Many border agents are furious at the orders coming from Biden and Secretary of Homeland Security Alejandro Mayorkas (who was impeached by the House of Representatives for his role in the border crisis). If you are a Border Patrol agent, you have to choose between obeying orders to open the border—or disobeying orders, descending into infighting, and furthering the breakdown of the rule of law in America.
This is exactly the kind of dilemma between lawlessness and lawlessness that Joe Biden and, much more so, Barack Obama love to use their power to impose! Biden has compared “maga Republicans” to Islamist terrorists, while Obama has called them bitter people clinging to guns and religion. These leaders do not want to defend conservative Americans from drug cartel agents and Latino socialists. Their goal is to use illegal immigration as a weapon to fundamentally transform America into a socialist nation.
Like other radicals, Obama believes that America is a racist society that needs to expiate its demons by special concessions, wholesale reparations and waging culture war. But he knows the need to mask that radicalism. So he tries to make it look like the border crisis is the result of the incompetence of his senile puppet president, Joe Biden, when it is really a calculated assault on American citizens meant to provoke a civil war with any conservatives who possess enough gumption to defend the Constitution.
Civil Disobedience
Twenty-six Republican attorneys general sent a letter to the Biden administration on January 29 defending Governor Abbott’s decision to continue laying razor wire and demanding that Biden “enforce the laws that secure the southern border.” The attorneys general represented Alabama, Alaska, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Utah, Virginia, West Virginia and Wyoming. This means a majority of the states believe we are in a constitutional crisis.
“It’s not an overstatement to say this is the worst constitutional crisis since the Civil War and that we’re in uncharted waters now,” the Federalist wrote. “There have been times in our history when a state has defied the enforcement of federal laws, but we’ve never faced a situation where the federal government has refused to enforce its laws and even violated them. And because the border crisis involves the question of security, Abbott’s assertion of state authority cuts right to the heart of the question at hand, which is one of first principles: Does a polity have the right to defend itself, to preserve its existence in the face of invasion?” (January 25).
This is a serious question! Governor Abbott is right that Article iv of the U.S. Constitution guarantees each state that the central government “shall protect each of them against invasion.” And he is right that Biden has broken this compact, and not by accident. The attorneys general can see this. But the question remains: What will these states do if the Biden administration continues trampling the U.S. Constitution? Will they give up and let radical Democrats keep importing Central American voters until America is as socialist as Nicaragua? Or will they follow Texas’s example and defy the federal government if that’s what it takes?
Abbott certainly has abundant legal reasons to disregard the Biden administration. Yet just as a Border Patrol agent defying orders sets a dangerous precedent, a state defying orders sets a dangerous precedent. If other states begin disregarding federal orders that are constitutional, what remains of the rule of law will finally give way to anarchy or the rule of brute force. Barack Obama has been working relentlessly toward both goals.
In his January 24 statement, Abbott noted that Article i of the U.S. Constitution establishes that a state shall not “engage in war, unless actually invaded, or in such imminent danger as will not admit of delay.” This emergency provision was included by the Founding Fathers so a state could fend off a surprise attack that the federal government was not prepared to repel. Now Texas has resorted to invoking a war clause to repel an invasion—an invasion that radicals in the federal government are actively facilitating for sinister purposes.
When states start invoking Article iv, Section 4 of the U.S. Constitution, it is getting serious! More than 600,000 people died in the U.S. Civil War; a second civil war would likely be even deadlier!
Civil War
The border crisis is one of several issues causing deep division in America. Could this, together with the stolen election crisis, cause Donald Trump to lead some states to secede?
In his July 2021 article “What Will Happen After Trump Regains Power” (theTrumpet.com/23957), our editor in chief explained that President Donald Trump was the legitimate winner of the 2020 election. He further said that the Bible prophesies Trump’s return to power, yet he “will have to fight for it. It doesn’t have to be military action, but it certainly could. President Trump could also lead some states to secede from the union.”
Yet even if America’s constitutional crisis does not end in literal secession as happened during the first civil war, the Bible prophesies that deep political division will destroy the nation unless the situation changes drastically.
That article further explained that President Trump is a type of King Jeroboam ii in 2 Kings 14:26-28, which states: “For the Lord saw the affliction of Israel, that it was very bitter: for there was not any shut up, nor any left, nor any helper for Israel. And the Lord said not that he would blot out the name of Israel from under heaven: but he saved them by the hand of Jeroboam the son of Joash. Now the rest of the acts of Jeroboam, and all that he did, and his might, how he warred, and how he recovered Damascus, and Hamath, which belonged to Judah, for Israel, are they not written in the book of the chronicles of the kings of Israel?”
This means that President Trump will have to fight to recover the office stolen from him. He is already fighting against lawfare, and he will likely have to fight against warfare as well.
A prophecy in Ezekiel 5:12 reveals that one third of the population of end-time America and Britain will die from the pestilence, famine and violence that will result from civil war. That equals more than 100 million deaths from rioting and warfare in the U.S.—170 times more than in the first Civil War! This type of curse requires rival military forces at odds with each other, indicating deep division even within the military.
President Trump could seal the border when he returns to office, but he cannot heal the deep political division between red states and blue states. Only God can heal this division, but first all Americans need to understand why such corruption has taken root in our government. Whether you are a Democrat or Republican, you need to recognize God’s warning and turn to the only hope left: repentance toward God!
