Biden Proposes Supreme Court Transformation
Joe Biden announced a proposal to reform the Supreme Court in an op-ed published by the Washington Post on Monday. He called for three reforms:
- A constitutional amendment that would limit presidential immunity
- Term limits on justices
- A new code of ethics
Biden began the op-ed by attacking the Supreme Court and some of its most recent rulings, saying it “undermines the public’s confidence.” He particularly singled out the court’s overturn of Roe v. Wade and the July 1 ruling that presidents are immune to criminal prosecution for official acts.
We now stand in a breach. That’s why—in the face of increasing threats to America’s democratic institutions—I am calling for three bold reforms to restore trust and accountability to the court and our democracy.

Term limits: Biden’s plan limits justices to serving 18 years on the court; every two years a new justice would be appointed by the president. This would require an amendment to enforce because it violates the Constitution, which grants judges a lifetime tenure.
Code of ethics: The court already has an ethics code, but Biden argues that a means of enforcement needs to be put in place.
Democrats often accuse the court’s conservative justices of breaking this code of ethics.
If Democrats want to adopt an across-the-board ethics ban for all branches, I am in favor of that: no jets, no meals, no speaking honorariums, no gifts for anyone from anyone for any reason in any branch, starting with Congress. Until they support that, let’s all be honest about what this is: a campaign to destroy a court that they disagree with.

Immunity: Biden also wants to reverse the court’s July 1 ruling by amending the Constitution to take away presidential immunity in a reform he calls “No One Is Above the Law.”
This is a direct attempt to overturn the court’s ruling that President Donald Trump has “absolute immunity” from prosecution for official acts. This would give the Democrats power to prosecute President Trump to try to stop him from returning to the presidency.
